July 25 · Andrew BerkowitzI contacted this firm twice regarding my case. During the first call, I was incorrectly informed that the statute of limitations with the EEOC was only one year. In reality, under the NYS Human Rights Law, the time limit extends to three years — a fact later confirmed to me by a family member who is a sitting circuit court judge.When I called back to clarify, my call was abruptly terminated. On a subsequent call, I attempted to address the misinformation, but the staff member repeatedly interrupted me, insisted that I had “misheard,” and ultimately called me “rude” when I persisted. I have a recording of the original call that confirms I was not mistaken.My experience reflects a serious lack of professionalism, accuracy, and respect. At no point did I speak with anyone who demonstrated a working knowledge of the relevant law. Instead, I was treated dismissively, as though my concerns were unworthy of serious consideration.
August 26 · Robert CassI contacted Schwartz, Perry & Heller seeking representation for an active wrongful termination and disability discrimination case — one already under investigation by the EEOC and NYC Commission on Human Rights. The intake process was promising, but my consultation with Brian Heller was the opposite.Rather than meaningfully engage with the facts, Mr. Heller repeatedly interrupted me and questioned well-established legal concepts such as “return-to-work dates” and protected leave status — terms any employment attorney should be familiar with. At several points, he stated my employer could “separate me at any time” despite my being on active short-term disability leave, ignoring the ADA and retaliation protections directly at issue in my case.When I clarified timelines and referenced ongoing federal and municipal investigations, his response was to suggest I simply “call them up” about missing legal notices — a comment that reflects either a lack of seriousness or a lack of understanding of due process requirements. The entire exchange felt more like being talked down to than being advised by a professional.This was not about the firm declining my case — that is their right. It was about the lack of respect for my time, my circumstances, and the legal protections at stake. I reached out to Schwartz Perry & Heller with a serious matter some time ago — instead, I was met with a front desk assistant who acted like she ran the entire firm. Condescending tone, constant interruptions, zero empathy. It felt less like a law office and more like trying to get past a bouncer at a club. What's worse? The firm defends her behavior rather than owning up to it — doubling down with defensive replies instead of basic professionalism. If this is the face of their brand, I want no part of what’s behind the door. Absolute shame...
April 21 · Mohammad AliBrutal and Dismissive Experience with Brian HellerI previously left a detailed review about my phone consultation with Mr. Heller and am reposting this final version with clarification — especially in light of the firm’s public response, which only further validated my concerns. Screenshots of my original review and their reply have been saved for context.This is not about a lawyer declining a case. That is their right. This is about how Mr. Heller treated someone in distress — with hostility, condescension, and an appalling lack of empathy.Rather than meaningfully hear my situation, Mr. Heller repeatedly interrupted me and asked, “But how is that racist?” — despite my clear explanation of bias and differential treatment. When I tried again, he cut me off and said, “Well, what if they just don’t like you?” as though racial discrimination is simply personal dislike. This wasn’t legal analysis — it was ignorance delivered with cruelty.Instead of helping me explore legal options, Mr. Heller made me feel small and foolish. He compared my case to someone else from the same workplace, saying theirs was a “bigger case” and an “easy win,” while implying mine wasn’t worth his time. It felt callous and transactional.More disturbing was his confident claim that it’s “not illegal” for an employer to deny EMS or medical care to an injured worker. That’s a gross oversimplification. OSHA’s General Duty Clause (Section 5(a)(1)) and Emergency Standards (29 CFR 1904.39) require employers to ensure prompt medical attention and a safe working environment. To reduce those protections to a technicality — just to dismiss someone’s suffering — is reckless and misleading.When I shared my experience in a review, the firm responded not with accountability but with deflection — accusing me of “hurling insults” and invoking Mr. Heller’s “25 years of experience” as a shield. But experience should teach empathy, not arrogance. Having “a rough day in court” is not a license to mistreat someone in need.This was never about whether my case would win. It was about the way I was treated: with contempt, emotional disregard, and ultimately, dehumanization.I have filed a formal grievance with the New York State Bar Association and have already notified my local Assemblymember of the experience. I also intend to notify my congressional representative, as I believe this kind of conduct — especially toward vulnerable callers seeking legal protection — cannot go unchecked. The law firm’s public response only escalates why this can’t be ignored.If this is how your office handles vulnerable callers and responds to justified criticism, it says far more about your values than it does about mine.
