As tumultuous or difficult as your divorce can sometimes seem, it is important to remember that you are dissolving your legal relationship with your spouse, and not with your children. New Jersey law recognizes the important role that both parents have on the health and development of children, so barring extreme circumstances such as a relocation or a history of domestic violence, both you and your spouse can expect to share some form of child custody and parenting time moving forward However, the way in which these issues are decided can often be as important as the actual child custody decision itself. At Jacobs Berger, we believe in pursuing open communication, negotiation, and mediation before seeking more aggressive forms of litigation when deciding such important family law issues.

Any time the parents of children divorce or dissolve their legal relationship, one of the most important issues that will need to be decided is that of child support. While the New Jersey Child Support Guidelines were developed in order to provide uniformity and fairness in child support settlements across New Jersey, these guidelines only determine how much one parent may expect to pay, or receive. They do not determine other critical aspects such as how exactly child support payments are paid or received, or whether or not a child’s college or post-secondary education will be accounted for as part of the child support agreement.

Legal parentage is primarily created through biology. However, the law permits various methodologies for creating families and therefore, various legal issues may arise when families which have been created are going through dissolution of the parents.Families can be created through adoption, through assisted reproductive technology efforts, and even through life experience. The formation of these families often requires complex legal agreements, litigation, and/or advice. Because the relationships between these family members are not automatic under the law, the parameters of the legal relationships often require written contracts so that all the parties involved are protected and know their individual rights and responsibilities.

Originally developed to help solve labor disputes, the benefits of Alternative Dispute Resolution quickly became apparent to attorneys involved in businesses and family law alike. Especially in the area of family law, ADR has proven to be an effective method for resolving divorce and family law issues while simultaneously helping clients to avoid the stress, and cost, of traditional courtroom-based litigation. In particular, our attorneys at Jacobs Berger have found that negotiation, mediation and arbitration provide spouses the opportunity to address their family law disputes with less hostility, and achieve custom-tailored results. While a judge may rule fairly, they may not take into account your unique situation, needs, and concerns when making their ruling. Through Alternative Dispute Resolution methods like Mediation and Arbitration, our firm can not only achieve fair resolutions for you, but resolutions which take your unique needs, and the needs of your family, into account.

- Domestic Violence
Domestic violence and abuse can take many forms, between parties with a variety of different types of relationships. The New Jersey Prevention of Domestic Violence Act (PDVA) of 1991 defines domestic violence as not only being physical violence, but emotional and financial as well.Along with these definitions, the PDVA also provides several options for abuse victims to secure legal protection from further acts of abuse, including securing a Temporary Restraining Order and later, a Final Restraining Order. Unfortunately, these same options are often used as a sword, rather than a shield.

- Equitable Distribution
Before any Morris County divorce can be granted, you and your spouse will first need to decide how you are going to divide the various marital assets and debts you have obtained over the course of your marriage. This process, sometimes known as the division of assets process, is often the most time-consuming and difficult aspect of any divorce. Not only will you have to decide which assets are considered marital assets, and not the property of one individual, you will also have to accurately value all of these assets, and divide them according to New Jersey equitable distribution laws. Equitable distribution means that your marital assets will need to be divided in a fair, but not necessarily equal, manner, and this important distinction is where having an experienced Morris County asset division attorney can be of enormous benefit.
- Estate Planning
- Family Law Appeals
Any time a family court makes a ruling regarding issues like child custody, child support, division of assets, alimony, etc, it may be possible to modify that order if certain circumstances change after-the-fact, or alternatively, appeal that order in a higher court. However, there are very specific timelines regarding when an appeal must be filed, and stringent rules and requirements in order for the process to be successful. Any time you are pursuing an appeal of a family court order, it is highly recommended that you retain experienced legal counsel to advise you of your options, help you comply with the many requirements of the courts, and work with you towards resolving the issue in your favor.

★ 5★ 4★ 3★ 2★ 1When my wife of 19 years blindsided me with the news that she wanted a divorce, I was scared that I'd be sleeping in my car. Jamie Berger assured me of what was actually happening, and allowed me to properly face the process. Jamie never asked for anything that was petty or spiteful, just fought was what was just and legal. She had my back, and I will never forget how that made me feel. Jamie Berger is a great lawyer, but a better person. (and she did NOT tell me to say that!)
April 04 · Seth EverettI had an incredibly frustrating experience working with Amanda P. Johnston. As a father, I sought legal representation to ensure that both my rights and, most importantly, my children’s rights were properly advocated for during a custody dispute. Unfortunately, this lawyer failed to do either. From the outset, it was clear that they were not committed to fighting for a fair outcome. I felt dismissed, unheard, and as though my concerns and the well-being of my children were secondary to pushing through the case as quickly and easily as possible. Despite presenting clear arguments and evidence that supported my case, Amanda P Johnston seemed uninterested in properly advocating for me or my children.I expected a professional who would stand up for my rights as a father and work in the best interest of my kids. Instead, I felt like my voice was silenced and that my children’s needs were ignored. I would not recommend this lawyer to anyone who is looking for someone who truly advocates for families and fathers in particular.
December 31 · Jeff FennerI couldn't be more disappointed with Jacobs Berger services.Divorce is a painful and traumatic process, where you need a lawyer who you can trust and make this process easier.Jamie Berger was my "lawyer". In our first meeting we went through my situation and I asked her all my rights as well I asked her to guide me during the process. She knew my financial situation since the beginning. I basically had no money and had to sell my car to pay for her services.I feel that they used some of my major concerns to make time on their favor, and on this way charge me more for their services. One example is my daughter's custody. They suggested me to make me changes that they knew my ex-husband was going to deny, but they made me believe that I could make these changes. Another situation was my daughter's child support, they inflated the amount I should receive for it so we could negotiate it. On this way they had calls with my ex-husband lawyer, they sent letters and of course they made money. My process was definitely not straight forward.I hired Jamie, but most of the time I talked to Amanda, Jamie's Paralegal. They also wanted to inflate my financial agreement with my ex, which I denied, because at this point I felt I was being fooled.I signed my divorce and they suggested me to receive part of my payment through their safe account, so I wouldn't have problems receiving my money. They received my payment on March 20, and they were going to send me my check as soon as it cleared their bank account. Today is April 2, and i haven't received my check. I have been contacting them because I really need my money, Amanda said she was going to see if my money was available, but I haven't heard from them anymore. So I definitely do not recommend their services.
April 02 · Karina Costa AraujoJamie helped me address some difficult and complicated situations. She and her firm did an amazing job. I am grateful for her honesty, candidness, as well as her ability to seek settlement. Although I sought her out specifically for her expertise, she also provided a healthy dose of humanity. Something I have found to be pretty rare in her area of practice. Thank You JamieI am looking forward to our best days ahead!
April 16 · Susannah ValletWhere do I start. Sarah Jacobs is an amazing lawyer. I was referred to Sarah after the attorney I had, was just not going to be powerful enough to handle my ex husband and his attorney. Sarah jumped in and took over immediately. The relief I felt instantly, was enough for a five star review. She is strong, incredibly smart and fair. I knew from the moment she took my case, that the direction of my divorce was going to shift, and it did. Sarah and her entire team at Jacobs Berger are amazing. From the front office staff to her partners. Professional, knowledgeable, and attentive. The best decision, for one of the hardest times in my life, was hiring Sarah Jacobs.
