- Child Custody
Child custody refers to the rights and obligations between parents, regarding their children, after a divorce, legal separation, or paternity decree. There are two independent types of custody. Physical custody refers to the amount of time each parent is permitted physically with a child. This may be sole, primary, or joint custody. Legal custody refers to a parent’s decision-making rights regarding a child’s health, education, and welfare. It, too, may be sole, primary, or joint custody.
- Child Custody Laws
- Child Support
Regardless of your fight to gain custody of your children, child support will be an issue in your case. You will either be paying it or receiving it. Courts have little discretion in setting the amount of child support to be paid. This is because, as a condition of receiving federal aid, the states are required to follow certain standards in their child support statutes. Although the exact procedures and details vary from state to state, there is a certain basic pattern no matter where you live.
- Contempt Proceedings
Contempt can only come into play after a court has issued judgments, orders or decrees to govern the behavior of the parents, which it can do at any point during the divorce proceedings. Once a court has issued such decrees, it is important for you to observe them to the best of your ability and, at the same time, to take note of any potential violations on the part of your ex-wife or former partner. Courts have been known to take it personally when a parent disregards their orders.
- Divorce Information – Petitions, Discovery, Settlement and Trial
Cordell & Cordell divorce attorneys work to ensure every client has the divorce information and family law resources they need to understand the divorce process and know what to expect before meeting with a family law attorney. A divorce can be a long process, and preparation is key in minimizing the length of your case.
- Establishing Paternity in a Divorce or Child Support Case
When the parents of a child are not married at the beginning of the pregnancy or at the birth of the child, the father is legally without the rights and responsibilities of a parent. The father, mother, or a third party on behalf of the child, must seek a declaration of paternity to legally establish a parent-child relationship with the father. This process gives the father specific custodial rights while imposing upon him a legal obligation to provide specific financial support for the child.
- Legal Separation
(In states where permitted.) Legal Separation is a court process designed to define the important rights and obligations between spouses when they live apart, but do not want divorce. The decree for legal separation establishes rules between the spouses regarding such issues as child custody, visitation, and spousal maintenance (alimony). It also divides property and usually debt. However, unlike divorce, the marital bonds are not severed and the spouses continue to be husband and wife. If, at any time during the legal separation, or thereafter, either spouse believes that the differences between them are irreconcilable, he or she may file a motion to convert to a dissolution of the marriage.
- Military Family Law
When a couple decides to end their marriage while one spouse is serving in the military, divorce tends to get more complicated. There are specific rules about where to file for divorce, how to calculate child support, how to determine child custody, how to divide retirement benefits, and more that you need to know. At Cordell & Cordell, we understand the unique challenges military families face during divorce. Our attorneys are able to handle these cases to ensure that your rights and the rights of your children are protected.
- Modification of Divorce Decrees
It’s not unusual for ex-spouses to want to change a prior decree respecting issues of custody and support. A party seeking to modify his decree must show a substantial and continuing change of circumstances. Those circumstances may include dramatic changes in income, relocation to another state, or problems relating to the proper care of his minor children. Cordell & Cordell will ensure that, to the extent possible, our clients’ goals are achieved in light of the new circumstances while preserving those rights provided for in prior decrees.
- Power of Attorney
Sending your child off to college is an exciting experience, but it also brings a lot of stress. As a divorced parent, you have enough to worry about without being concerned about having access to your son or daughter’s educational, medical, financial, and other critical information.
- Prenuptial Agreements
- Property Division and Asset Division
Every marriage has at least one topic in common – property. Whether they own a million-dollar mansion or a beat-up RV, a couple will always have to divide up the property and debt. Certain assets remain the exclusive property of one of the marriage partners, even after marriage, and some will be divided. This is done with debts as well. Most debt incurred while married will be shared upon dissolution, though a few personal debts may remain exclusively yours.
- Protection Order
Protection orders are unfortunately common in family law cases and are often used for strategic reasons. The misuse of a protection order when going through a divorce is one of the more prevalent and unfortunate trends in family law. A system that was designed to protect against abuse is itself being abused.
- Spousal Support, Alimony, Maintenance
In some instances a wife will ask for alimony, the court-ordered payment of money to your wife after the dissolution of marriage. If you made more money (especially if you were the primary breadwinner), there is a good chance your wife will seek alimony. The bigger the difference in earnings and the longer you were married, the larger the alimony payment will be.

★ 5★ 4★ 3★ 2★ 1As upsetting as needing an attorney for any legal matter can be it is extremely comforting when you find someone that you have all the confidence in the world in. Diona was so thorough and well prepared I always knew the outcome was going to be in my favor. It was a pleasure to work with her, and I know she will do her best for all her clients no matter the situation. Highly recommend, and can’t say enough about her professionalism.
May 20 · Brooks BONIFACIUSHaving just recently gone thru a divorce I can say without a doubt that my attorney Diona Potter is one of the best attorneys I've ever met. Due to my profession I have met a lot of attorneys over the past 40 plus years. Attorneys that specialized in various fields of law from criminal, civil, divorce, real estate, etc... one attribute that all attorneys should have is a professional demeanor and above all else, they need to make the person they are representing seem like more than just another client. She does that well, and you know she is interested in you and your case. Diona was referred to me by a couple of men who had used her services and Cordell & Cordell in the past and I trusted their judgement. She did not disappoint. Specifically when I would call, text, or email, if she couldn't answer right then, she would get back to me in a timely manner. I never had to call, text, or email twice. She would listen to what I had to say and what I thought about how things were going and then she would offer her counsel and (we) would decide what was the best approach, response or course of action should be. She did not try to manage me but did manage the case.On the contrary the attorney that my ex-wife was using seemed to be an exact opposite of Diona. Many times during the divorce proceedings her attorneys office had to be contacted multiple times to get answers to questions, documents, etc...I can also relate that there were times when my ex-wife would call me or I would see her and she would be emotional, crying, upset because her attorney had yelled at her, cussed at her, wouldn't respond to her calls and/or emails and basically made a bad situation even worse. I won't name that attorney but I know they will never get a referral from my ex-wife or me.You will never get that kind of behavior or response from Diona Potter or any of the staff I dealt with at Cordell and Cordell. They are true professionals from the lady at the front counter to others doing work behind the scenes.Bottom line, I'm glad the guys I know referred me to Diona and the team at Cordell and Cordell. They truly are their to assist you and look out for your best interest.
December 22 · Tom ArnoldDiona Potter is the best out there! Her availability was infinite. She was completely transparent throughout my divorce, very informative and resourceful. Diona never missed a beat, she was always early and came well equipped to take on whatever the opposing party threw at us. I was very satisfied at the end result. In all, I wouldn't recommend nobody else for the job. Thank you Diona!!
May 23 · Kareem TaylorPaid $200 for a consultation with Attorney Potter and I’m honestly not sure what I paid for. I gave a detailed description of my case and asked 7 questions to gauge whether I wanted to hire her or not and she just talked in circles for the entire hour. She didn’t answer none of my questions and was very long winded. I will not be hiring this firm bc if she talked for 1 hour about absolutely nothing, I can’t imagine how much my total cost would be at $390 a hour for her to represent me. Honestly, I want a refund. Some of the questions I asked were how long would it take her to get up to speed on my case, has she handled cases like mine and what were the outcomes, what are the possible outcomes of my case, can she identify anything that I can settle on, and how can I avoid future cases. All of her answers were “I don’t know.” I am looking for an attorney with a strategy. If I explain my case in detail, I expect you to be able to provide insights based on your experiences. This was supposed to be legal advice. I want my $200 back.
February 14 · Just The KingsI made the mistake of getting a divorce without representation. When I later had a mediation session, I did have representation but I never felt that my Council at that time was really fighting for me.I discovered Cordell & Cordell online and thought to give them a try since they indicated the do a lot of work specifically for men.I was assigned to Diona Potter and from our very first visit to our last meeting, I felt that she truly listened to what I had to say and the details of my case. Diona helped me through a mediation for the dispersal of the proceeds of the sale of my house. While I would have liked things to go more my way, I felt that Diona was in my corner and was fighting for me.I will definitely be reaching out to Diona if i have any need to legal representation from my divorce. She was very easy to work with and obviously has a lot of valuable experience.
